What is a Trademark?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

A trademark is any sign or any combinations of signs that is capable of distinguishing goods or services (including word marks, figurative elements, hologram marks, sound marks, smell and texture marks and colours or any combination of these) offered by one undertaking from those offered by another. There are two basic characteristics; it must be distinctive and it should not be deceptive.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Collective and Certification Marks<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Collective marks usually belong to a group or association or enterprises. The use is reserved to the members of the group or association and distinguishes the goods and services of members of the association from those of other undertakings. The function is to inform the public about certain particular features of the product. An enterprise which uses the collective mark may use its own trademark too.<\/p>\n\n

Certification marks indicate that the goods or services are certified by the proprietor of the mark in respect of the origin, mode of manufacture of goods or performance of services, quality, accuracy or other characteristics thus distinguishing those goods or services from others not so certified. Certification marks may only be used in accordance with the defined standards (Eg: ISO 9000). The typical feature is that the certification mark is not used by the holder but instead by the authorised users. The function is to guarantee the relevant public that goods or services possess a particular characteristic.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Some companies have successfully established worldwide renown via their trademarks or service marks. Customers are capable of recognizing and identifying their goods and services, their qualities and features without referring to the location of the company in question. These trademarks are called well-known marks.<\/p>\n

Eg:<\/strong> Apple, McDonald\u2019s, amazon, etc.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The term of trademark registration can vary, but is usually ten years. It can be renewed indefinitely on payment of additional fees. Trademark rights are private rights and protection is enforced through court orders.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
